GENERAL TERMS AND CONDITIONS OF USE (GTCU)

Hype Soft Sàrl declines all contractual or extra-contractual liability for any direct or indirect, tangible or intangible damage resulting from access to, use of or inability to access the site or its contents.

These General Terms and Conditions of Use (GTCU) govern access to and use of the website, software, platforms and online services operated by Hype Soft Sàrl, a company under Swiss law located at Rue des Gares 12, 1201 Geneva, Switzerland, IDE CHE-432.029.501 (hereinafter "Hype Soft", "the Publisher" or "the Provider").

Use of the site, Hype Software, Hype Telecom service, or any associated service (collectively the "Services") implies full and complete acceptance of these Terms and Conditions.

Any person accessing the Services is deemed to have read, understood and accepted them without reservation.
Simplicity and transparency
Client / User: any natural or legal person accessing Hype Soft Services.
Software / Logiciel: Hype Software proprietary application made available under license.
Hardware: equipment sold, rented or installed by Hype Soft.
Customer Area: secure interface allowing the management of subscriptions and user account.
Partners: external service providers involved in the provision of services (e.g., NEXI, hosting providers, telecom operators).
Win-win partnership
These Terms of Service define the conditions for accessing, viewing, and using Hype Soft Services, including:

Navigating the website www.hypesoft.ch;

The use of Hype Software and its modules (sales, cash handling, reporting, inventory, etc.);

Internet and telephone connection provided by Hype Telecom;

Administration, support and update tools.
A vibrant, connected, and collaborative community

The Services are accessible 24/7, except in cases of interruption for maintenance, updates or force majeure.

Hype Soft reserves the right to temporarily suspend access for technical or security reasons.

Access may be restricted or interrupted in the event of non-compliant or fraudulent use of the Services.
Safety first

The user must create a personal account to access certain Services.

He is responsible for maintaining the confidentiality of his usernames and passwords.

In the event of unauthorized use or loss of access, Hype Soft must be notified immediately.

Any operation carried out from the user's account is deemed to have been carried out by the user.
Loyalty and kindness
The user agrees to:

Use the Services in accordance with the law, best practices and these Terms of Service;

Do not disrupt the operation of the site or software (attempted intrusion, overloading, hacking, etc.);

Hype Soft remains the sole owner of the copyright and ownership rights to the Hype Software.

The user obtains a personal, non-exclusive and non-transferable right of use.

Any unauthorized reproduction, extraction or distribution is strictly prohibited.
Processing of personal data in accordance with the Law
Hype Soft processes personal data in accordance with the revised Federal Data Protection Act (DPA) and, where applicable, the GDPR.
The information collected is used solely for:

Account and subscription management;

Billing and customer support;

Security and technical maintenance.

Commitment and responsibilities

Hype Soft is committed to maintaining a high level of security and availability, but cannot guarantee uninterrupted access.

Hype Soft can only be held liable in the event of gross negligence or intentional misconduct, and only for direct damages.

It cannot be held responsible for data loss, access interruptions, indirect damages or damages related to third-party partners (e.g., NEXI).
Deletion and termination

Hype Soft reserves the right to suspend or terminate, without notice, access to any user who does not comply with these Terms of Service or applicable law.

The Client remains liable for amounts due until the effective date of termination.
Adaptation of the General Terms and Conditions of Use
Hype Soft may adapt these Terms and Conditions at any time.
Users will be notified of changes by email or on the website.
Continued use of the Services constitutes acceptance of the new terms.
Expertise and exclusivity
These Terms and Conditions are governed by Swiss law.
Any dispute falls under the exclusive jurisdiction of the courts of the canton of Geneva, subject to mandatory provisions.
