Hype Soft Sàrl declines all contractual or extra-contractual liability for any direct or indirect, tangible or intangible damage resulting from access to, use of or inability to access the site or its contents.

    This Privacy Policy aims to inform Hype Soft Sàrl's customers, users, and partners about the collection, use, protection, and storage of their personal data in connection with the use of the products and services offered by:

    • Hype Software (management and point-of-sale software),

    • Hype Telecom (connectivity, Internet and telephony),

    • And the associated services (training, maintenance, inventory, hosting, etc.).

    Hype Soft Sàrl is committed to ensuring transparency, security and compliance of data processing in accordance with the revised Federal Data Protection Act (LPD) of September 1, 2023 and, if applicable, the General Data Protection Regulation (GDPR) of the European Union.

  • No sensitive data

    Hype Soft only collects data that is strictly necessary for the provision and proper execution of its services.


    This data may include:

    • Identification data: name, surname, company name, address, telephone, email;

    • Contractual and billing data: bank details, payment history, subscriptions, options;

    • Technical data: IP addresses, connection logs, hardware identifiers, session cookies;

    • Commercial data: preferences, interactions with customer service, history of tickets or interventions;

    • Data from external partners: (e.g. NEXI for payments, operators for connectivity).

    No sensitive data (ethnic origin, health, religion, political opinions) is collected.

  • Personal data

    Personal data is processed for the following purposes:

    ​

    1. Contractual execution: subscription management, sales, invoicing, support, maintenance and installation;

    2. Technical management: securing, hosting, updating and proper functioning of the software and hardware;

    3. Customer service and communication: handling requests, interventions and technical assistance;

    4. Continuous improvement: anonymous statistical analysis of performance and customer satisfaction;

    5. Legal obligations: compliance with Swiss tax, accounting and legal provisions;

    6. Commercial prospecting (B2B only): sending information relating to Hype Soft products and services, unless the Client objects.

  • The treatment

    Data processing is based on:

    • The performance of the contract (Art. 6, para. 1, let. b GDPR / Art. 31 LPD);

    • Compliance with legal obligations (Art. 6, para. 1, let. c GDPR);

    • Hype Soft's legitimate interest (security, improvement, statistics);

    • The explicit consent of the Client, when required (marketing, communication, newsletter).

  • Hosting

    The data is hosted on secure servers in Switzerland, subject to Swiss jurisdiction.
    Hype Soft implements all appropriate technical and organizational measures to guarantee:

    ​

    • The confidentiality, integrity and availability of information;

    • Protection against unauthorized access, loss, alteration or disclosure.

     

    Automatic backups are performed regularly.
    Access to the data is strictly reserved for authorized Hype Soft personnel and, where applicable, its subcontractors subject to a confidentiality clause.

  • Data with third parties

    Hype Soft may share certain data with third parties only when necessary for the provision of services, including:

    ​

    • NEXI Suisse SA for payment transactions;

    • Connectivity providers / telecom operators;

    • Technical and hosting providers;

    • Competent authorities, upon formal legal request.

     

    No data is sold or transmitted for unauthorized commercial purposes.

  • Data retention

    Personal data is stored:

    ​

    • During the term of the contract and up to 30 days after its termination, unless otherwise required by law;

    • Up to 10 years for billing and accounting data, in accordance with Swiss tax requirements;

    • Until consent is withdrawn for processing based on it (marketing, newsletter).

  • In accordance with the Law

    In accordance with the Swiss Federal Act on Data Protection (LPD) and the General Data Protection Regulation (GDPR), the Client has the following rights:

    ​

    • Right of access to one's personal data;

    • Right to rectification of inaccurate data;

    • Right to erasure (“right to be forgotten”) within legal limits;

    • Right to data portability;

    • Right to object to processing for legitimate reasons;

    • Right to withdraw consent, without affecting the lawfulness of prior processing.

    A response will be provided within a maximum of 30 working days.

  • Cookies

    Hype Soft uses technical and analytical cookies only for:

    • Improve website navigation;

    • To measure the traffic to its pages;

    • Facilitate access to the customer area.

     

    No advertising cookies or profiling are carried out without explicit consent.
    The user can disable cookies in their browser settings.

  • Payments

    Payments made via NEXI or other providers are fully secured according to PCI DSS standards.
    Hype Soft does not store any banking data.

  • Changes possible at any time

    Hype Soft may modify this policy at any time.
    The changes come into effect on the date indicated at the top of the document.
    Customers will be informed by email or via the website www.hypesoft.ch .

  • For legal purposes

    This Policy is governed by Swiss law.
    Any dispute relating to data protection falls under the jurisdiction of the courts of the canton of Geneva.
