SUBSCRIPTION REFUND AND EARLY CANCELLATION POLICY

These provisions, as well as all information appearing on this site, are provided by Hype Soft Sàrl, without any guarantee of completeness, accuracy or timeliness.


Hype Soft Sàrl declines all contractual or extra-contractual liability for any direct or indirect, tangible or intangible damage resulting from access to, use of or inability to access the site or its contents.

The texts, documents, and information provided do not constitute legal, commercial, or technical advice. The user remains solely responsible for their use of the published information.

Hype Soft Sàrl expressly reserves the right to modify, supplement or delete all or part of the site content, as well as these provisions, at any time and without notice.

Swiss law applies, to the exclusion of all other legislation. In the event of a dispute, the exclusive place of jurisdiction is the registered office of Hype Soft Sàrl, subject to any mandatory jurisdictions provided by law.

  • Hype Soft Sàrl / Hype Software / Hype Telecom

    This policy specifies the conditions of termination, early cancellation and refund applicable to subscriptions, services and sales concluded with Hype Soft Sàrl, a company under Swiss law, located at Rue des Gares 12, 1201 Geneva (IDE CHE-432.029.501).

    It supplements the General Terms and Conditions of Sale (GTC) and the Subscription, Sales and General Terms and Conditions applicable to the software, hardware and services operated under the Hype Software and Hype Telecom brands.

  • Simplicity and transparency

    Any subscription or contract concluded with Hype Soft is firm and binds the Client for the initial period chosen: 12, 24 or 36 months.


    The Client acknowledges that the electronic or handwritten signature of the contract constitutes firm acceptance of the commitments undertaken and the corresponding amounts.

    In the event of early termination, promotional discounts or benefits granted are retroactively cancelled, and the amounts due are recalculated at the standard rate.

  • In accordance with Swiss law

    In accordance with Swiss law, the 14-day right of withdrawal provided for by European consumer legislation does not apply to contracts concluded between businesses (B2B).


    For individual customers, a withdrawal may be accepted within 7 days of signing, only if no installation, configuration, or service has begun.

    All cancellation requests must be submitted in writing (registered mail or certified email) to: hype@hypesoft.ch

  • Early cancellation

    In the event of cancellation of a contract before its effective implementation, the Client remains liable for:

    • 100% of the installation costs (CHF 888.–), and;

    • All costs incurred for preparation, travel, setup or training already planned.

    These fees cover irrecoverable logistical and human costs.

  • Termination before the end of the contract period

    In case of termination before the end of the contractual period:

    1. The Customer loses the benefit of all applied discounts (-5%, -10% or special promotions).

    2. The amounts due are recalculated at the standard rate over the entire period elapsed.

    3. The Client must pay the full balance of the remaining monthly installments until the end of the initial commitment period.

    4. The equipment provided remains the property of Hype Soft until full payment is received.

  • Welcome offer

    6.1 Special Offer – Hype Software Entry

    • 1st month → Free (-100%)
    • 2nd month → –37.5%
    • 3rd month → –37.5%
    • From the 4th month → normal price

    In the event of cancellation during the first three months, the Client must:

    • Settle retroactively for the three months at the normal rate, and;

    • Pay the full installation costs (CHF 888.–).

    6.2 Other offers

    The GOLD and PLATINUM offers (including the free integration of 50 or 150 inventory items) are maintained only if the 24-month commitment period is fully honored.


    Any early termination cancels these benefits and the integrated items are re-invoiced at the current unit price (CHF 5.80 to CHF 7.80 / item).

  • Returns and Refunds

    No returns or refunds will be accepted:

    • After installation, activation or use of the hardware;

    • If the hardware has been customized, configured, or integrated into the Hype Software system.

    In case of cancellation before delivery, administrative fees of 10% of the pre-tax amount may be retained.

    Defective products reported within 7 days of delivery will be exchanged or repaired, in accordance with Article 4.6 of the Hype Soft Contract.

  • Total or partial non-payment

    In the event of total or partial non-payment, the following measures will automatically apply:

    • Default interest: 5% per annum (art. 104 CO);

    • Reminder fee: CHF 30.– per message;

    • Service suspension: after 10 days of delay, without prior notice;

    • Automatic termination: after 30 days, with immediate payment of the outstanding balance;

    • Recommissioning fee: CHF 100.–.

    No refund requests will be accepted during a suspension period.

  • Refunds

    Refunds are only possible in the following cases:

    1. Billing error due to Hype Soft, confirmed in writing;

    2. Service not provided due to a failure exclusive to Hype Soft and not related to an external partner;

    3. Early termination by Hype Soft for just cause.

    Refunds are made within 30 working days by bank transfer, less an administrative fee of CHF 20.–.

  • No refund

    No refunds are given for:

    1. Outages or interruptions related to external service providers (e.g., NEXI, Internet operators);

    2. Loss of profit, lost earnings or indirect damages;

    3. Delays due to force majeure or non-performance by the Client (obligation to provide the necessary information or access);

    4. Client's breach of contract.

    The request must include: contract number, invoice concerned, reason and bank details.

  • For legal purposes

    This policy is governed by Swiss law, in particular the Swiss Code of Obligations (CO).
    Any dispute falls under the exclusive jurisdiction of the courts of the canton of Geneva, subject to mandatory provisions.
